Terms of Service
Last updated Oct 19, 2026
1. About these Terms
These Terms apply to every quote, order and purchase from Topiku, and to your use of topiku.co.
Topiku is operated by Tokunusa Pte. Ltd., a company incorporated in Singapore (UEN 202646698K), with its registered office at 109 North Bridge Road, #07-22, Funan, Singapore 179097. In these Terms, "Topiku", "we", "us" and "our" mean Tokunusa Pte. Ltd. "You" means the business or organisation placing an order, and anyone using our website.
We make custom and blank headwear for businesses and organisations. By placing an order, you confirm you are buying for business purposes and have authority to accept these Terms for your organisation. If you buy as an individual consumer, nothing in these Terms limits the rights you have under the laws where you live.
If your quote, invoice or order confirmation says something different from these Terms, that document applies for that order.
2. Quotes and orders
Quotes are valid for 30 days unless they say otherwise. Prices, minimum quantities and lead times are as set out in your quote or our current order guide.
Your order is confirmed once you have approved the final mockup and order details in writing (email is fine) and we have received your deposit.
We may decline any order, including artwork we believe is unlawful, offensive or infringes someone else's rights.
3. Artwork, mockups and samples
We prepare a mockup of your design free of charge, and you can ask for revisions before you approve it.
Please check your mockup carefully, including spelling, colours, size and placement. We produce what you approve, so errors in an approved mockup are your responsibility.
A mockup shows how your design will look. It is not exact to scale or colour, and thread colour, print colour and placement can vary slightly in production.
Our fabrics are upcycled from deadstock and production leftovers, so shades can vary between batches and from what you see on screen.
Our hats are made by hand. Small variations between units are normal and are not defects.
Samples are paid in full before production. A sample shows our materials and workmanship; bulk production may vary slightly from it.
4. Pricing and payment
Prices are in US dollars unless your quote states another currency.
Prices do not include shipping, import duties, taxes, customs fees, or your own bank and card fees, unless your quote says so.
Unless we agree otherwise in writing, payment works like this:
50% deposit when your order is confirmed. Production starts once we receive it.
The remaining 50% when production is complete. We ship once we receive it.
You can pay by bank transfer or card, as shown on your invoice. A payment counts as received when cleared funds reach our account.
If a payment is late, we may pause production or hold your shipment, and delivery dates will move accordingly.
5. Production and delivery
Lead times start when your order is confirmed. They are estimates, not guarantees.
A delivery date is guaranteed only if we confirm it in writing on your order confirmation or invoice. If we miss a guaranteed date for reasons within our control, we will refund the price of the late items.
We ship from Indonesia by air courier, such as DHL. Shipping is quoted separately.
Orders ship duties unpaid (DDU). You pay any import duties, taxes and customs fees in the destination country. If customs holds your shipment, we will help with the paperwork, but customs delays and charges are outside our control.
You can use your own shipping account or label if we arrange it with you before dispatch.
Risk of loss passes to you on delivery. If you use your own shipping account, it passes when we hand your order to your carrier.
If your order arrives damaged or does not arrive, tell us within 7 days of delivery (or the expected delivery date). We will work with the carrier to resolve it.
If you give us a wrong address or refuse delivery, you pay any return and reshipping costs.
6. Changes and cancellations
You can change or cancel an order free of charge until it is confirmed.
After confirmation, changes may affect the price and lead time. We will confirm both with you before going ahead.
If you cancel after confirmation but before production starts, we will refund your deposit, less costs already incurred for your order, such as materials and embroidery setup.
Once production has started, a custom order cannot be cancelled and the full price is payable.
7. Quality, defects and returns
Please check your order when it arrives. Report any defect, missing item or wrong item within 14 days of delivery, with photos.
A defect is a fault in materials or workmanship, or a product that does not match the approved mockup. The normal variation described in section 3 is not a defect, and neither is damage from misuse, wear, or not following care instructions.
For a confirmed defect, we will repair or replace the affected items, or refund or credit their price, at our choice. If we ask you to return them, we will cover the return shipping.
Custom products are made to your specification and cannot be returned or exchanged unless they are defective. Blank (non-custom) products can be returned under our Return Policy.
8. Intellectual property
Your artwork stays yours. You confirm that you own, or have permission to use, every logo, design, name and image you send us, and that producing it will not infringe anyone's rights.
You allow us to use your artwork only to quote, produce and deliver your order.
We may photograph finished products and show them in our portfolio, catalogue and marketing. If you would prefer we don't, tell us in writing and we won't.
If a third party makes a claim against us because of artwork you supplied, you agree to cover our resulting losses, costs and reasonable legal fees.
Our name, logo, product designs, photos and website content belong to us or our licensors. You may not use them without our written permission, except to show and sell products you bought from us.
9. Sustainability information
We may give you product data, impact figures and media to help you talk about the products you buy from us.
If you make environmental or social claims about those products, you are responsible for them and for complying with advertising and consumer laws where you sell. Use our information as we provide it, and do not attribute claims to us that we have not made.
Certifications and memberships shown on our website do not certify your products or your organisation.
10. Liability
We warrant that our products match your approved order and are free from defects in materials and workmanship when delivered. Section 7 sets out what we will do if they are not. Apart from this, and to the extent the law allows, we give no other warranties, express or implied.
We are not liable for indirect or consequential loss, including lost profits, lost revenue, lost business, or a missed event or campaign.
Our total liability for any order is limited to the amount you paid us for that order.
Nothing in these Terms limits liability that cannot be limited by law, such as liability for fraud, or for death or personal injury caused by negligence.
11. Events outside our control
We are not responsible for delays or failures caused by events outside our reasonable control. These include natural disasters, extreme weather, pandemics, strikes, power or internet outages, carrier or customs delays, supplier failures and government action.
If this happens, we will tell you promptly and do what we reasonably can to limit the delay.
If the delay lasts more than 60 days, either of us may cancel the affected part of the order. We will refund what you paid for items not delivered, less costs already incurred for your order.
12. Using our website
Use our website only for lawful purposes. Do not upload malicious code, scrape the site, try to get around its security, or submit false or infringing material.
Website content is general information. Prices, products and details may change, and the site may contain errors. Your quote and order confirmation are what count.
Links to other websites are for convenience. We are not responsible for their content or practices.
Our website and online store are hosted on Squarespace. We may change, suspend or remove any part of the website at any time.
How we collect and use personal information is set out in our Privacy Policy.
13. General
These Terms are governed by the laws of Singapore, and the courts of Singapore have jurisdiction over any dispute.
We may update these Terms by posting a new version on this page with a new date. The version in force when your order is confirmed applies to that order.
These Terms, together with your quote, invoice and order confirmation, are the entire agreement for your order. They replace any earlier discussions about it.
If any part of these Terms cannot be enforced, the rest still applies.
If we do not enforce a right straight away, we have not given it up.
A person who is not a party to these Terms has no right to enforce them under the Contracts (Rights of Third Parties) Act 2001 of Singapore.
